Even though you and your spouse are in agreement, it is important that you each have your own attorney to draft your pre- or post-nuptial agreement. Your interests need to be represented.  

Especially if significant assets are involved, it can add harmony to a marriage to have a good agreement in place that specifies the division of assets in the case of a separation or divorce. It is wise to hope for the best, and also wise to plan for the worst.
